Is it allowed to use AI-generated content commercially in Brazil under the new AI regulatory framework?

Brazil’s federal AI bill (Bill 2338/2023) passed important Senate stages in late 2024 and includes a chapter setting transparency, copyright and remuneration rules for AI developers and users: proposals require disclosure of copyrighted works used to train models, create a regulatory body and experimental platform to negotiate payments to creators, and give creators the right to opt out of having their works used for model training. The text aims to allow commercial use of AI outputs while protecting creators’ rights, mandating transparency and potential compensation when protected works were used during training. Practical implication: commercial use of AI-generated material in Brazil will be permitted but employers and AI companies will face compliance duties (transparency, licensing or remuneration arrangements) and creators may withhold consent for training use—companies should track the bill’s final passage and prepare licensing/record-keeping processes.
